VATRA · THE HEARTHEST. APRIL 28, 1912 RECOGNIZED JUNE 13, 1912

INTELLECTUAL PROPERTY & INSTITUTIONAL RESOURCES

Media & Image Usage Policy

Preserving Our Heritage. Protecting Our Identity.

VATRA's historical identity, official seal, photographs, publications, and archival materials form an important part of the Federation's institutional legacy. This policy explains how those materials may be accessed, attributed, requested, and used responsibly.

1. Purpose and Scope

The Pan-Albanian Federation of America Vatra (The Hearth), Inc. ("VATRA," "the Federation," "we," "our," or "us") maintains a public website containing institutional information, historical materials, photographs, publications, archival references, and other media associated with its history and ongoing activities.

These resources serve educational, cultural, historical, journalistic, and institutional purposes.

This Media & Image Usage Policy explains VATRA's expectations concerning the reproduction, distribution, modification, attribution, and authorized use of its official identity and materials.

The Policy applies to media and intellectual property owned or controlled by VATRA and to requests directed to the Federation for permission to use such materials.

Some materials appearing on VATRA's website are owned or controlled by third parties. Their use may require permission from those respective rights holders.

Nothing in this Policy grants VATRA rights it does not possess or eliminates lawful uses protected by applicable copyright, trademark, or other laws.

2. Official Institutional Identity

The Federation's full legal name is:

The Pan-Albanian Federation of America Vatra (The Hearth), Inc.

The public-facing institutional name is VATRA.

The organization traces its establishment to April 28, 1912, in Boston, Massachusetts, and its recognition by the Commonwealth of Massachusetts to June 13, 1912.

The names, institutional insignia, and historical identifiers associated with the Federation form part of its established identity.

No person or organization may falsely represent itself as VATRA, claim to be authorized to speak on its behalf, or imply official Federation sponsorship or affiliation without appropriate authorization.

The use of VATRA's name for accurate historical reference, scholarship, commentary, reporting, or other lawful purposes is not categorically prohibited.

3. Federally Registered VATRA Seal

VATRA's official historical seal is a federally registered United States trademark.

Registered owner: The Pan-Albanian Federation of America Vatra (The Hearth), Inc.
USPTO Registration Number: 7,870,502
USPTO Serial Number: 90187864
Registration Date: July 22, 2025

The registered mark incorporates the Federation's historical seal design and associated wording.

The registration is maintained with the United States Patent and Trademark Office and protects the mark in connection with the services identified in the federal registration, subject to applicable law.

The registered seal must be distinguished from the organization's general historical name and other visual materials that may not be separately registered.

The Federation reserves the trademark rights legally associated with the registered seal. Unauthorized use of the mark in a manner that infringes applicable trademark rights is prohibited.

Uses falsely suggesting that a person, company, chapter, publication, commercial product, website, or other organization is officially sponsored, approved, or operated by VATRA are not permitted.

Requests for institutional or promotional reproduction of the registered seal should be directed to the Federation.

Nothing in this Policy prohibits legally permitted referential, descriptive, historical, journalistic, or other non-infringing uses.

4. Integrity of the Official Seal

Persons and organizations receiving authorization to use the official VATRA seal must preserve the integrity of the approved artwork. Unless expressly authorized, the registered seal may not be:

  • Redesigned or substantially modified
  • Recolored in a way that misrepresents an approved official version
  • Distorted or stretched
  • Cropped in a way that removes identifying elements
  • Combined with unrelated commercial marks in a misleading manner
  • Altered to change historical dates or inscriptions
  • Recreated with modified institutional wording
  • Used to imply an unauthorized affiliation
  • Applied to merchandise or promotional materials beyond the scope of applicable authorization

Authorized uses should employ the official artwork supplied or approved by VATRA. Where reproduction specifications are provided, recipients should follow those specifications.

Historical photographs and archival reproductions containing earlier versions or period-specific depictions of the seal may be presented accurately as historical materials. The Federation does not require alteration of authentic historical artifacts merely to reflect contemporary trademark notices.

5. Use of the VATRA Name and Institutional Identity

The name VATRA may appear in journalism, research, historical publications, educational materials, citations, and other lawful forms of discussion.

Accurate identification of the Federation is distinct from the unauthorized creation of an official-looking institution, chapter, or publication. A person or organization may not falsely present itself as the Federation or misrepresent that it has authority to conduct official VATRA activities.

The use of the Federation's official seal, formal institutional identity, or protected insignia for organizational branding generally requires appropriate authorization when such use implicates trademark rights.

The Federation reserves the right to address misleading representations of institutional authority and infringing uses of its intellectual property.

This provision does not prohibit criticism, independent journalism, historical commentary, scholarship, or other legally protected expression.

6. Website Text, Photographs, and Creative Materials

VATRA's website may contain original written content, photographs, illustrations, graphics, layouts, videos, and other creative material.

Where VATRA owns the relevant copyright or has received an applicable assignment or license, it may exercise the rights granted by law or the applicable agreement.

Certain website materials may be provided by external authors, photographers, contributors, publishers, archives, or partner institutions. In those circumstances, the respective rights holders may retain ownership or control over reproduction and distribution.

The presence of content on VATRA's website does not automatically authorize third parties to reproduce, redistribute, commercially exploit, or modify that content.

Visitors seeking permission for reproduction should identify the specific material and the proposed use. Permission may need to be obtained from the actual copyright owner rather than VATRA.

7. Historical and Archival Materials

VATRA's historical collections and website presentations may include:

  • Founding records
  • Archival photographs
  • Historical correspondence
  • Newspaper pages
  • Manuscripts
  • Historical publications
  • Institutional documents
  • Photographs of notable historical figures
  • Community records
  • Other materials relating to Albanian-American history

Some materials may be in the public domain. Others may remain protected by copyright or be subject to contractual, archival, privacy, or donor restrictions.

Possession of a physical document or a digital scan does not automatically establish ownership of all copyright interests associated with the underlying work.

The Federation seeks to preserve the authenticity, provenance, and historical context of materials presented through its website. Reproductions should accurately identify the source where known.

Users should not alter historical materials in a way that creates a misleading account of the original document. Digital restoration, cropping, transcription, color correction, or translation should be disclosed where such changes could materially affect historical interpretation.

8. Attribution and Source Identification

Persons receiving permission to reproduce VATRA-owned materials may be required to provide appropriate attribution. Attribution requirements depend on the particular work and the terms of the authorization.

A recommended attribution format, where applicable and accurate, is: "Courtesy of The Pan-Albanian Federation of America Vatra (The Hearth), Inc."

This wording should be used only when VATRA is the appropriate credited institution or source. Where a third-party archive, photographer, publisher, or individual owns the material, the relevant owner and source should be credited as required.

A preferred descriptive caption may include title or description, date, creator or photographer, historical location, collection or source, rights holder, and any required credit line.

Attribution does not replace permission when permission is legally necessary. Likewise, permission to use a particular work does not automatically eliminate attribution obligations established by an agreement.

9. Dielli Newspaper and Editorial Materials

Dielli — The Sun, founded in Boston in 1909, is the historic newspaper associated with VATRA. The newspaper's present publishing website is https://gazetadielli.com/.

Dielli contains journalism, historical reporting, commentary, interviews, essays, photographs, and contributions from numerous authors across its history.

Ownership and reproduction rights in particular articles, photographs, and archival editions may depend on the date of publication, authorship, contracts, applicable law, and the rights held by the Federation, newspaper, authors, or other persons.

The appearance of material in Dielli does not automatically establish that every work may be freely republished. Visitors wishing to reproduce substantial article text, photographs, historical editions, or other protected materials should determine the appropriate rights holder and obtain authorization where required.

Ordinary links to publicly available Dielli articles do not require the reproduction of entire articles. Short excerpts, citations, and other uses may be permissible under applicable copyright law.

Publication in Dielli does not automatically mean that an individual editorial opinion constitutes an official position of VATRA. Formal institutional statements should be identified according to their actual issuing authority.

10. News Reporting, Research, and Educational Use

VATRA recognizes the importance of journalism, scholarship, historical research, public discussion, and cultural education.

Applicable copyright law permits certain uses without the copyright owner's permission, including uses qualifying as fair use under United States law. Fair use is evaluated according to the facts and circumstances of the particular use. Relevant considerations include:

  • The purpose and character of the use
  • The nature of the copyrighted work
  • The amount and substantiality used
  • The effect on the potential market for the original work

Educational or nonprofit purpose does not automatically make every reproduction a fair use. Similarly, commercial purpose does not automatically make every use unlawful.

The Federation does not require permission for uses that are independently lawful under applicable copyright or trademark law. Where a proposed use exceeds a lawful exception or involves protected institutional branding, permission should be requested from the appropriate rights holder.

11. Media and Press Use

Journalists, broadcasters, publishers, documentary producers, and other media organizations may request access to appropriate institutional information and materials. Requests may involve official seal artwork, authorized institutional photographs, historical photographs, event images, biographical information, historical documents, approved institutional statements, archive reproductions, and interview-related materials.

VATRA may review requests based on ownership, rights, historical accuracy, privacy, institutional authority, and the nature of the proposed use.

Providing a photograph or other file does not necessarily grant unrestricted reproduction, modification, redistribution, merchandising, or sublicensing rights. The scope of any authorization should be documented.

The Federation is not obligated to provide materials it does not own, control, or have permission to distribute. Independent news reporting and uses permitted by law remain unaffected by this request process.

12. Institutional Chapters and Affiliated Organizations

Recognized VATRA branches and authorized representatives may have legitimate needs to use Federation branding for approved institutional activities.

Use of the official name and seal must remain consistent with the Federation's Constitution and By-Laws, applicable Branch Agreements, trademark rights, and any additional authorized brand standards.

A chapter or organization may not assume authority to license VATRA's registered seal to unrelated third parties without appropriate permission. Past use of the seal does not automatically establish current authorization.

Groups that are not recognized or authorized by the Federation must not use VATRA's protected identity in a manner that falsely suggests official recognition or affiliation.

The use of the name or seal for historical reference, lawful commentary, or other non-infringing purposes is governed by applicable law. Requests for official branding should be reviewed through the appropriate institutional process.

13. Institutional Events and Photography

VATRA may photograph or record authorized institutional gatherings, ceremonies, cultural events, lectures, and other activities. Such materials may be used for documenting institutional history, reporting on Federation activities, preserving event records, publishing approved photographs, preparing official institutional communications, and creating historical archives.

The rights and privacy considerations associated with event images may vary according to the location, circumstances, subjects, intended use, and applicable law.

Where required or appropriate, VATRA should provide notice or obtain consent or releases before using identifiable persons' images, particularly for promotional or commercial uses. Attendance at an event does not automatically establish blanket permission for every possible future use of a person's likeness.

Private events, restricted meetings, sensitive circumstances, and recordings involving confidential institutional matters may require additional controls. Photographs or recordings should not be presented in a misleading context.

14. Photographs of Children and Minors

Special care must be taken when publishing photographs or other identifiable information involving minors.

VATRA and its recognized community partners may organize or document educational and cultural activities involving children. Publication of identifiable photographs of minors should be supported by appropriate parental or guardian permissions where required or appropriate, particularly for promotional or public-facing uses.

The Federation should avoid publishing unnecessary identifying information about children. The website should not disclose private student records, sensitive personal information, residential addresses, or other information that could compromise a child's privacy or safety.

School and youth-program photographs supplied by outside organizers should be reviewed for appropriate publication rights and permissions before use.

15. Third-Party Submissions and Contributions

Individuals may offer historical documents, photographs, manuscripts, written materials, or other media for consideration by VATRA. Submission of a work does not automatically transfer copyright or ownership of the original material to the Federation.

The contributor should identify, to the best of their knowledge, the creator or photographer, approximate date, source or collection, any known copyright holder, known restrictions on use, and whether the contributor possesses authority to grant permission.

VATRA may request additional documentation before publishing or reproducing contributed material.

Acceptance of a digital copy does not automatically establish an archival gift, copyright assignment, exclusive license, or custodial agreement. Substantial archival donations, original-object transfers, and publication licenses should be documented separately where appropriate.

VATRA may decline material that cannot be authenticated, lawfully reproduced, or appropriately preserved.

16. Permission Requests

Requests for permission to use VATRA-controlled materials should be directed to the Federation through its official website.

A permission request should identify:

  1. The person or organization requesting permission.
  2. The specific material requested.
  3. The proposed use.
  4. Whether the use is commercial, educational, journalistic, institutional, or otherwise.
  5. The intended publication or distribution platform.
  6. The intended geographic distribution, where relevant.
  7. The anticipated publication or use date.
  8. Any proposed modification, cropping, or translation.
  9. Whether the material will be supplied to additional parties.
  10. The requested duration of use.

VATRA may seek further information necessary to determine whether the proposed use can be authorized. Submitting a request does not itself grant permission. Silence or a lack of response does not constitute approval.

Authorization should be expressly communicated by an officer or representative with appropriate authority. The Federation may decline requests where appropriate or where it lacks the rights needed to authorize a proposed use.

Submit a request through the official Contact page and select “Media, Image & Trademark Permissions.”

17. Conditions of Authorized Use

When VATRA grants permission to reproduce or use a particular protected material, the authorization may specify the particular materials covered, approved purpose, permitted media or platforms, duration of permission, geographic scope, required attribution, restrictions on alteration or sublicensing, requirements for maintaining historical accuracy, and requirements for reviewing sensitive uses.

Unless otherwise stated in the permission, rights not expressly granted remain reserved to the extent provided by law. An authorization for one project does not automatically apply to unrelated projects.

A permission to reproduce a historical photograph does not automatically include permission to use VATRA's registered seal as an endorsement. Likewise, use of the seal in an authorized institutional publication does not create general merchandising or licensing rights.

18. Prohibited Misrepresentation and Misleading Uses

VATRA objects to uses of its protected institutional materials that unlawfully misrepresent affiliation, authorization, source, or endorsement. Examples may include:

  • Presenting an unauthorized organization as an official VATRA chapter
  • Using the registered seal to falsely imply official sponsorship
  • Altering a historical document and presenting it as authentic
  • Fabricating an institutional announcement with the official logo
  • Presenting fictional historical imagery as genuine archived material
  • Using a photograph in a materially deceptive context
  • Creating counterfeit institutional certificates or credentials
  • Selling merchandise bearing infringing versions of the registered mark
  • Misrepresenting an individual as an authorized Federation officer

This provision addresses unlawful or misleading conduct and does not prohibit legitimate criticism, parody, research, historical analysis, news reporting, or other legally protected activity.

20. Corrections and Historical Authenticity

VATRA recognizes the importance of accurate historical presentation. The Federation may review claims concerning incorrectly identified photographs, dates, authorship, institutional roles, archival provenance, or document authenticity.

When a material error is substantiated, VATRA may correct accompanying descriptions or otherwise address the issue.

Corrections should preserve the authenticity of historical documents. The Federation should not silently alter original manuscripts, historical newspaper pages, adopted constitutional provisions, or other archival source materials in a manner that misrepresents their original content.

Where digital restoration or editorial annotation is used, the changes should be distinguishable from the original material when material to historical understanding.

21. No General Public License

Unless a particular item expressly identifies an applicable public license or other permission, the appearance of material on VATRA's website does not constitute a general license for unrestricted copying, commercial exploitation, distribution, alteration, or use of protected trademarks.

Visitors remain free to engage in uses independently permitted by applicable law. Where permissions are required, they must be obtained from the appropriate rights holder.

Materials specifically identified as public domain should not be represented as subject to exclusive VATRA copyright solely because a copy is displayed on the website.

22. Changes to This Policy

VATRA may revise this Policy to reflect changes in its website, intellectual-property portfolio, archival resources, publication practices, institutional procedures, or applicable legal requirements.

The current approved version should remain accessible at this webpage. The displayed effective date or last-updated date must reflect actual approval or publication.

Material changes may be communicated through additional notices where appropriate. This Policy does not amend the Federation's Constitution and By-Laws or replace separate written licensing arrangements.
